R Walt Coleman reviewed the play, determined that Brady seemingly halted his passing motion and was attempting to "tuck" the ball back into his body, it was an incomplete pass, not a fumble.
The Patriots got the ball back, with under a minute left in regulation, K Adam Vinatieri #4 kicked a 45-yard FG to tie the game at 13, that sent the game into OT, which Vinatieri kicked a 23-yard FG for the win.
This was the final game ever played at Foxboro Stadium.
